1.1. The text below is an Agreement between the online store wroom.new.hor-hosting.top (hereinafter the “Seller”), represented by sole proprietor Yaroslav Beley (FOP Bielei Yaroslav Serhiiovych, EDRPOU/TIN code: 3804801619), and the user of the online store services, regardless of status (individual, legal entity, or sole proprietor), hereinafter the “Buyer”. The Agreement includes all essential conditions of organizing distance sales (via the online store). Hereinafter the Buyer and Seller together are referred to as the “Parties”, and separately as a “Party”.
1.2. This Agreement, in accordance with Articles 633, 641 and Chapter 63 of the Civil Code of Ukraine, is a public contract (offer) and is addressed to an indefinite number of persons, regardless of status (individual, legal entity, or sole proprietor), who wish to purchase goods in the online store wroom.new.hor-hosting.top.
1.3. Since this Agreement is a public offer, by gaining access to the materials of the Website, the User (Buyer) is considered to have joined this Agreement.
1.4. The Website Administration (the owner of the site wroom.new.hor-hosting.top and/or persons authorized by them) has the right to change the terms of this Agreement at any time unilaterally. The new or amended Agreement enters into force after it is posted on the Website. If the User does not agree with the changes made, they must refuse access to the Website and stop using the materials and services of the Website.
1.5. The Buyer agrees to this public offer fully and unconditionally when placing an Order on the Website.
1.6. The Visitor (Buyer) agrees that all the terms of this Agreement are clear to them, and they accept it fully and without reservations.
2.1. To place orders on the Website, the User (Buyer) may complete the registration procedure and provide the necessary data according to the registration form.
2.2. When registering on the Website, the User (Buyer) undertakes to provide accurate and truthful information about themselves and their contact details in order for the Website Administration to fulfill its obligations to the User (Buyer) and to deliver the paid Goods.
2.3. During registration, the User (Buyer) specifies a login (their e-mail) and password, for the security of which they are responsible. The User (Buyer) undertakes not to disclose the login and password specified during registration to third parties and to store this data in a place inaccessible to others. The Buyer bears full responsibility for all actions performed on their behalf, i.e., using their login and password.
3.1. The information provided by the User (Buyer) is confidential. The Website Administration uses the information about the User (Buyer) to fulfill the Visitor’s (Buyer’s) Orders, unless otherwise stated in this Agreement.
3.2. By filling out the registration form on the website wroom.new.hor-hosting.top, the Visitor (Buyer) voluntarily consents to the collection and processing of their personal data by the Website Administration for the following purposes: the data provided by the Visitor (Buyer) during registration will be used to process Orders for the purchase of Goods, provide information about Orders, send (by electronic communication means – e-mail and mobile communication) promotional and special offers, information about promotions, giveaways, or any other information regarding the activities of the website wroom.new.hor-hosting.top, and for other commercial purposes.
3.3. For the purposes specified in this clause, the Administration has the right to send letters, messages, and materials to the postal address and e-mail of the Visitor (Buyer), as well as send SMS messages and make calls to the phone number specified in the form, if necessary to fulfill the User’s (Buyer’s) Order. The Administration has the right to record telephone conversations with the Visitor (Buyer) in order to improve the quality of service, and the Visitor (Buyer) gives their unconditional consent to this.
3.4. The Visitor (Buyer) agrees to the use of cookies by the Administration. Cookies do not contain personal information and cannot in any way read data from the Visitor’s (Buyer’s) hard drive. Cookies are used to improve the quality of services provided, including: quick identification of the Visitor (Buyer); saving the Visitor’s (Buyer’s) settings and personal preferences; tracking the Visitor’s (Buyer’s) session state and behavior patterns. The Administration also uses cookies for advertising purposes, including managing ads on websites across the Internet. If cookies are disabled for wroom.new.hor-hosting.top or some of its services by the Visitor (Buyer), the Administration does not guarantee the full functionality of the website.
3.5. The Buyer grants the Administration the right to process their personal data, including: storing the personal data in the Administration’s databases (without additional notice), storing it indefinitely, accumulating, updating, and modifying it as necessary. The Administration undertakes to protect the data from unauthorized access by third parties and not to distribute or transfer it to any third party (except for related parties, commercial partners, persons authorized by the Administration to process the data for the stated purposes, and in response to a mandatory request from a competent state authority).
3.6. If the Visitor (Buyer) does not wish to receive promotional messages about campaigns, new products, etc., they have the right to unsubscribe by sending a letter to the Administration and/or by setting the appropriate option in their personal account.
3.7. The Administration is not responsible for the content and accuracy of the information provided by the Visitor (Buyer) during registration on the website wroom.new.hor-hosting.top and when placing an Order. The Visitor (Buyer) is responsible for the accuracy of the information provided and accepts all risks associated with the inaccuracy of such information.
4.1. The Visitor (Buyer) may place an order independently by clicking the “Buy” and “Checkout” buttons, or by phone at the number indicated at the top of the page. After placing an order, the Buyer will receive a confirmation message at the contact details specified during checkout, informing them of the availability of the goods or the expected delivery date in case the goods are out of stock. When ordering by phone, notification is provided by phone.
4.2. If a product listed on the Website is not actually available due to technical issues or for other reasons beyond the control of the Administration, such an order may be canceled fully or partially, and the Visitor (Buyer) will be notified by a message.
4.3. By accepting this Agreement and placing an order, the User (Buyer) confirms that they have read the “Delivery and Payment” and “About the Store” sections of the Website, agree with them, and fully understand them. The Administration reserves the right to change the delivery time of an order, notifying the User.
4.4. The Visitor (Buyer) agrees that the price of a product placed in the “cart”, its assortment, and quantity are only valid at the moment of forming the cart and may change if the purchase is not completed by clicking the “Checkout” or “Buy” button.
4.5. The Visitor (Buyer) agrees that the purchased Goods are not subject to exchange or return in the following cases:
4.5.1. More than 14 calendar days have passed since the purchase of the Goods.
4.5.2. Less than 14 calendar days have passed since the purchase, but the Goods were used, the integrity of the packaging and/or completeness has been violated, tags/labels are missing, etc.
- The Goods are included in the list of products that are not subject to return and exchange according to the Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994 (as amended).
4.5.3. The Visitor (Buyer) refuses to provide photo or video materials of the defective and/or faulty goods, in their opinion.
4.5.4. The Visitor (Buyer) confirms that they are informed that promo codes or certificates cannot be exchanged for money, can be used only once, and in case of use, the difference between the face value of the certificate and the order amount is not refunded.
4.5.5. The Visitor (Buyer) confirms that when returning goods paid partially or fully using a certificate code, the monetary equivalent of the certificate is not refunded; the certificate code is automatically restored and considered unused.
4.6. Under this Agreement, the User (Buyer) confirms that only new goods that have not been used and show no signs of use (scratches, chips, scuffs, etc.) are subject to exchange or return, and that the full set of the goods, integrity and all elements of the packaging, tags, and factory markings are preserved; the Visitor (Buyer) has the original document confirming the purchase of the respective Goods. Violation of any of these points gives the Administration the right to refuse exchange or return.
4.7. When ordering goods on the Website, the User (Buyer) confirms their consent to receive information about the production date and shelf life of the product in the format provided by the brand-manufacturer, including by means of a batch code printed on the product packaging or other manufacturer markings.
4.8. When ordering goods on the Website, the User (Buyer) confirms their consent to combine several orders made for the same recipient into one package and deliver them as a single shipment. In case of combining orders, the User (Recipient) will be notified by an e-mail message.
4.9. The Website Administration informs, and the User (Buyer) agrees that when placing an order, they may purchase no more than 5 units of goods with the same code in one order.
4.10. In case the Visitor (Buyer) refuses the Goods, the Administration refunds the amount paid by the Buyer, excluding the Seller’s costs related to the return delivery of the Goods from the Buyer.
5.1. The Administration bears no responsibility for any errors, inaccuracies, or omissions that may be found in the materials contained on this Website. The Administration makes all reasonable efforts to ensure that the information provided on the Website is accurate and reliable. All information and materials are provided on an “as is” basis, without any express or implied warranties.
5.2. The Administration is not responsible for any statements or opinions of Visitors (Buyers) of the Website left in comments or reviews.
5.3. The Administration is not responsible for possible unlawful actions of the Visitor (Buyer) towards third parties or unlawful actions of third parties towards the Visitor/Buyer.
5.4. The Administration is not responsible for any losses or expenses (actual or possible) arising in connection with this Website, its use, or inability to use it.
5.5. The Administration is not responsible for the loss by the User (Buyer) of access to their account on the site wroom.new.hor-hosting.top (loss of login, password, or other information).
5.6. For the purposes described above, the Administration reserves the right to delete information posted on the Website and to take technical and legal measures to restrict access to the online store for Users (Buyers) who create difficulties in using the online store for other Visitors (Buyers), or who engage in bad faith behavior when placing orders which are not aimed at actual purchase, or for Visitors (Buyers) who violate the terms of this Agreement. Such blocking is performed at the Administration’s discretion without further notice to such Users (Buyers).
5.7. The Website Administration is not responsible, including but not limited to, for:
5.7.1. Delays or failures in transactions caused by force majeure, as well as any problems in telecommunications, computer, electrical, and other related systems.
5.7.2. Actions of payment systems, banks, money transfer systems, and any delays related to their operation.
5.7.3. Proper functioning of the Website if the Visitor (Buyer) does not have the necessary technical means to use it, and the Administration has no obligations to provide such means.
6.1. All objects available through the services of the Website wroom.new.hor-hosting.top, including design elements, text, graphic images, illustrations, videos, software, databases, music, sounds, and other objects (hereinafter – the content of the services), as well as any content posted on the website wroom.new.hor-hosting.top, are subject to exclusive rights of the Administration, Users, or other rights holders.
6.2. The use of content and any other elements of the services is allowed only within the functionality provided by a particular service. No elements of the content of the services of the Website wroom.new.hor-hosting.top, as well as any content posted on the services of the Website wroom.new.hor-hosting.top, may be used in any other way without the prior permission/consent of the rights holder. “Use” includes, but is not limited to: reproduction, copying, processing, distribution on any basis, display in a frame, etc. Exceptions are cases directly provided for by the legislation of Ukraine. The use by the User of content elements for personal non-commercial purposes is allowed, provided all copyright and related rights notices, trademarks, and other notices of authorship are preserved, and the name (or pseudonym) of the author/right holder is kept unchanged, as well as the corresponding object is kept unchanged. Exceptions are cases directly provided for by the legislation of Ukraine.
